I note that another matter of residents being blocked off by surrounding properties has arisen at Mount Friendship in St. Michael.
My understanding is that this matter may be resolved under the current Highways Act Cap 289 Section 25 – 1 which makes provision for a road to church and market in such circumstances.
Those requesting the road will be required to pay the cost of the land over which the road is to be built. Such costs may be arbitrated by a jury empanelled to determine such.
While the act stipulates that those requesting the road are also required to pay for it, the cost of such today may well be prohibitive and may require “state” intervention.
That road when completed is designated as a public road.
