The educator, who was 43 years old at the time of the alleged offence, had been accused of having sexual intercourse with a 13-year-old girl, sometime between November 1 and 30, 2002. He had denied the allegation.
When the matter came up for hearing in the No. 5 Supreme Court before Madam Justice Jacqueline Cornelius Wednesday, the virtual complainant said she was no longer interested in giving evidence in the case and wanted to move on with her life.
Through questioning by the prosecutor Principal Crown Counsel Anthony Blackman, the alleged victim assured the judge she had not been forced, threatened or intimidated into making the decision.
Blackman said the Crown was therefore no longer in a position to proceed with the matter and requested that the case be dismissed.
As such, Justice Cornelius let the accused man, who was represented by attorney-at-law Arthur Holder, go free.
